The first thing we look at when evaluating a personal injury case is the incident itself. How serious was the crash? Were there any aggravating circumstances? For example, was the other driver intoxicated, texting, or using their phone at the time of the accident?
We also consider the venue of the case, meaning where the accident occurred, and we look at what other juries in that area have done in cases involving similar facts.
Another important factor is the injury itself—both its nature and its severity. How extensive was the medical treatment? How long did it take for that treatment to help our client recover to where they were before the accident, if they were ever able to recover fully? We also examine the client’s health immediately before the crash and how the accident affected that health.
The amount of insurance coverage available to compensate our client is another important consideration.
Finally, we look at how the injury has affected our client’s daily life. We consider the everyday activities that many of us take for granted and determine the value of what has been lost.
Determining the ultimate value of a personal injury case is difficult and complex. Every case is different, which is why you need a law firm with the experience to guide you through the process.
